SUBMISSION OF DOCUMENTS IN A FOREIGN LANGUAGE

In terms of Article 12 of the Industrial Property Code approved by Decree 47/2015, of December 31, all applications must be submitted in Portuguese. The same applied to supporting documents, if in a different language, a Portuguese translation was required.

However, from February this year, there has been a slight change in this procedure. With the approval of the new Industrial Property Institute (IPI) fees through Ministerial Diploma No. 154/2023, of December 29, the submission of documents in a foreign language is now permitted.

The Ministerial Diploma that came into force in February 2024, provide for an additional procedure regarding the submission of supporting documents.

The applicant can choose to present the documents in a foreign language with the respective sworn translation or to present the documents in a foreign language only and pay the fee created specifically for this purpose, which is equivalent to 50% of the normal fee (i.e., 50% of the due fee). Therefore, there will be no requirement to present the translation of the document into Portuguese if the applicant select to pay the additional fee.

This is applicable to all types of amendments such as change of name, change of address, assignment contracts, merger contracts, franchise contracts, exploitation licenses, and right of use licenses.
